What is a non-molestation order?
A non-molestation order is an injunction which you can apply for through the family courts. This type of Order is granted to prevent a partner, or former partner, from causing you or children any harm. Harm does not just mean physical harm, but instead also includes harassment, intimidation and psychological abuse as well as any threatening behaviour against you or your family. Breaking a non-molestation order is a criminal and attestable offence.
What is an occupation order?
An occupational order regulates or restricts an individuals rights to occupy a property, such as the family home, and surrounding area. This order is at the courts discretion to decide who should live in or return to the family home and can be a useful method of protection for individuals at risk of harm. Unlike a non-molestation order, when an occupation order if breached, an arrest can only be enforced if a power of arrest has been filed alongside the occupational order.
