A prenuptial agreement ("pre-nup") is a document used by couple's to set out their intentions in relation to property, debts, income and other assets that might be brought into the relationship or purchased together and/or individually acquired (such as inheritance).
There is a misconception that prenuptial agreements are only for the rich and famous, however these can also be used in every day situations where you might be thinking of getting married again.
Is a prenuptial agreement legal binding? Currently, they are not legally binding documents. However, they are used and becoming more accepted by the courts to evidence what the couples intentions were should they wish to divorce in the future.
How long before our wedding should a prenuptial agreement be signed? It should be signed at least 28 days before the marriage. You can discuss any specific requirements that you might have with your solicitor in the lead up to your marriage to ensure all details are disclosed and agreed in advance of the signing of the agreement.
