What is a separation agreement?
A separation agreement is a written agreement between both spouses which outlines their financial responsibilities. It can address what happens if the family home is sold; Or if one party wishes to reside in the family home, it can outline who is responsible for paying the mortgage and household bills and any other responsibilities you may have.
Why might a separation agreement be preferred over divorce?
A separation agreement offers religious benefits for couples who do not wish to be divorced. Additionally, if you are unsure whether you should dissolve your marriage or civil partnership, a separation agreement gives you time apart from your spouse and sets out your responsibilities and agreement formally.
Why might I need a solicitor?
Separation agreements are not legally binding therefore, to ensure that the agreement is upheld, certain legal requirements need to be addressed.
There may be certain financial assets that you may not be aware that you are entitled to share. Therefore, it is important to declare all of your assets, income and liabilities.
